Florida Insurance Law Requirements
Florida law requires a specific manner of conduct by your insurance company with regard to its handling of your claim. These requirements are all a part of the legal duty to deal fairly and honestly with the insured.
Whenever you submit a claim and are awaiting payment, it can be frustrating and the amount of time that it takes may easily appear to be much longer than necessary. Whether or not your carrier is complying with the legal requirements of good faith and fair dealing is based on an objective standard of reasonableness. If your carrier fails to meet any one of these requirements it may not be acting in bad faith. However, if you believe that your insurance company’s handling, attempts to settle, or denial of your claim are unreasonable, you may have a case for bad faith.

Pay your claim in a reasonable period of time.

Within 30 days provide a written notice that it is investigating your claim.

Explain denial of your claim fully and in writing.

Begin with the assumption that your claim should be paid.

Request additional information if necessary and explain why the information is needed.

Conduct fair practice, including:

Require as few statements and estimates as possible.

Set appointment times for statements and estimates that are reasonable.

Clarify the terms of your policy that are relevant to your claim.

Keep you informed of the progress of your claim.
